They are defined by their DESIGN, COLOUR, SHAPE, TEXTURE, MATERIAL OR DECORATION
Why protect a design?
If the visual appearance of a product constitutes a commercial advantage or forms part of your business, YOU MUST PROTECT IT.
The term of protection is 5 years, extendable up to 25 years.
Types of Designs
Two-dimensional
Defined by shapes, lines or colours.
Three-dimensional
Defined by volume, texture or shape.
Key features
New
A design is considered new if no identical design has been made public.
(12-month plan for the designer).
Unique Character
A design is considered to be innovative if the overall impression it makes on informed users differs from the overall impression made by any other design that has been made public.
